Online Conduct and Behavior

As a Member, you agree that:
You are solely responsible for the content or information you publish or display on the www.Vagr.com web site, or transmit to other www.Vagr.com Members.
You will NOT post on our service, or transmit to other www.Vagr.com members or employees, any, racially offensive, abusive, obscene, harassing, profane, offensive, sexually oriented, threatening, inaccurate, or illegal material, or any material that violates another party's rights.
You will use the www.Vagr.com service in a manner consistent with any and all applicable laws and regulations. You will not include in your profile any telephone numbers, E-mail addresses, street addresses, last names, URL's, or offensive sexually suggestive or connotative language, offensive anatomical or sexual references, and you will not post any photos containing nudity or personal information. Vagr.com reserves the right, but has no obligation, to reject any profile or photo that does not comply with these prohibitions and conditions.
You will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through the Service. You will not transmit any chain letters or junk E-mail to other www.Vagr.com members.
You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.
You are solely responsible for your interactions with other www.Vagr.com members. Vagr.com reserves the right, but has no obligation, to monitor disputes between you and other members. Any infraction may lead to legal remedy on behalf of www.Vagr.com.

Indemnity by Member
If you are a California resident, you waive California Civil Code  1542, which states:
"A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
Vagr.com reserves the right, but has no obligation, to monitor disputes between its members.
You will defend, indemnify, and hold harmless Vagr.com, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses, including reasonable attorneys' fees, relating to or arising out of your use of the www.Vagr.com service, including, but not limited to, any breach by you of the terms of this Agreement.
Use of the www.vagr.com site and/or its service is governed by our Privacy Policy, which may change any time upon notice.

Removal of Data, Profile and Information
While we do not and cannot review every message sent by users of the Service, and are not responsible for any content of these messages, we reserve the right, but are not obligated, to delete or move content including without limitation profiles, public postings and messages, that we, in our sole discretion, deem to violate the code of conduct set out above or any applicable content guidelines, or to be otherwise unacceptable. You shall remain solely responsible for the content of profiles, public postings and messages you may transmit or record to the Service or send to the users of the Service.
Vagr.com takes no responsibility for stolen, fake, third party profile pictures.
We have done our best to protect and prohibit such actions by our members or visitors.
People using fake or third party pictures in their profile, will be rejected from our site.
If noticed any such activity, please report us through System Abuse page.

Refund Policy
www.Vagr.com will issue a refund of an initial subscription provided that none of the Services have been utilized. Beyond these conditions, requests for refunds will be at the sole discretion of www.Vagr.com and will be reviewed on a member to member basis.
The subscription fees were provided upon registration may change from time to time, with email notice.
www.vagr.com reserves the right to terminate your access to the site for any reason or no reason.
Vagr.com may terminate your membership upon sending notice to you at the email address you provide in your application for membership or such other email address as you may later provide to us.
If Vagr.com terminates your membership in the www.vagr.com service because you have breached this Agreement, you will not be entitled to any refund of any unused subscription fees. Even after this Agreement is terminated, certain provisions will remain in effect

Proprietary Rights

www.vagr.com contains the copyrighted material, trademarks, and other proprietary information of Vagr.com and its licensors. In addition, other members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
By posting information or content to any public area of www.Vagr.com, you automatically grant, and you represent and warrant that you have the right to grant, to Vagr.com and other www.Vagr.com members an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

Information Supplied by Member
Except as provided otherwise in www.Vagr.com privacy policy, we will keep confidential all information supplied by you to Vagr.com, including credit card numbers, and shall use or disclose such information only for the purposes for which such information was collected, or as required by law.

Disclaimer of Warranty
www.Vagr.com Service on an "as is" basis and grants no warranties of any kind, express, implied, statutory, in connection with the Service or in connection with any communication with Vagr.com or its representatives, or otherwise with respect to the Service. Vagr.com specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Vagr.com does not warrant that your use of the www.Vagr.com service will be secure, uninterrupted, always available, or error-free, or will meet your requirements, or that any defects in the Service will be corrected. Limitation of Liability

General Provisions
You agree that California law (regardless of conflicts of law principles) shall govern this Agreement, that any dispute arising out of or relating to this Agreement shall be subject to the exclusive venue of the federal and state courts in the State of California, and that you submit to the exclusive jurisdiction of the federal and state courts in the State of California in connection with the service or this agreement. This Agreement, accepted upon registering for the www.Vagr.com service, contains the entire agreement between you and Vagr.com regarding the use of the site.
The parties to the arbitration shall evenly divide any and all costs of the arbitration. Neither party shall be entitled to attorney fees, unless otherwise stated by a court.
All parties submit to exclusive jurisdiction in Los Angeles, California. The arbitration shall take place exclusively in Los Angeles County,
This Agreement may only be amended upon notice by www.Vagr.com to you, or by a writing signed by you and an authorized official of Vagr.com unless otherwise explicitly stated, the Terms will survive termination of your membership to the service.
Software from this site is further subject to United States export controls policies. No software from this site may be downloaded or otherwise exported or into Cuba, Iraq, Libya, North Korea, Iran, Syria, or any other country to which the U.S. has embargoed goods; or to anyone on the U.S.
Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders.
By downloading or using the Software, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.
If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

Copyright and trademark Policy
You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights or otherwise have a valid basis under the law.
Termination of User Privileges for Infringement and Contact Information for Suspected Copyright Infringement:
We will terminate the privileges of any user who uses this Site to unlawfully transmit copyrighted material without a license, express consent, valid defense or fair use exemption to do so. In particular, users who submit user content to this Site, whether articles, images, stories, software or other copyrightable material must ensure that the content they upload does not infringe the copyrights or other rights of third parties.
